LIMITATION OF LIABILITY
Buyers must be at least 18 years of age to purchase our knives.
Buyers are solely responsible for being informed of their Federal, State and Local laws to determine the legality of any knives or
tools purchased.
By purchasing a knife by internet, mail, phone, or at our shop, the buyer declares that they are of legal age to purchase, are in
compliance with all applicable laws, and you are purchasing our knives to be used in compliance with those laws. The buyer
agrees to hold DAVID R. BECK, KNIFESMITH, LLC not liable for any actions taken against them due to their misrepresentation,
or their non-compliance of those laws, or laws from other localities in which they possess, transport, or use our products.
Products manufactured and sold by DAVID R. BECK, KNIFESMITH, LLC are intended and sold for legitimate sporting,
utilitarian, or collectable purposes only.
DISCLAIMER
UPON PURCHASE THE BUYER AGREES TO WAIVE AND RELEASE UNCONDITIONALLY, AND TO INDEMNIFY,
DEFEND AND HOLD HARMLESS DAVID R. BECK, KNIFESMITH, LLC FROM ANY AND ALL DAMAGES, LIABILITY,
LOSSES, FEES AND EXPENSES, INCLUDING ATTOURNEY, AND OTHER LEGAL FEES OF DAVID R. BECK
KNIFESMITH, LLC, AND COSTS ARISING FROM, OR RELATED TO YOUR BREACH OF ANY TERMS, CONDITIONS, OR
WARNINGS REGARDING PROPER USE, OR AGAINST ABUSE, OR MISUSE OF ANY PRODUCT MANUFACTURED OR
SOLD BY DAVID R. BECK, KNIFSMITH, LLC.
YOU, THE BUYER/USER OF PRODUCTS MANUFACTURED AND SOLD BY DAVID R. BECK, KNIFESMITH, LLC
UNDERSTAND AND AGREE THAT; (a) THE HANDLING AND USE OF KNIVES AND OTHER SHARP TOOLS INVOLVE
INHERENT RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS,
AND DEATH (RISKS), whether handled or used improperly or as intended due to their inherent risks; (b) these risks and dangers
may be caused by the user's own actions or inactions, the actions or inactions of others, unintentional, unforeseen, or unnoticeable
defects in the manufacture of our products, from a products MISUSE, ABUSE AND NEGLECT, SECOND PARTY
ALTERATIONS or SERVICES, or FAILURE TO FOLLOW THE DIRECT ADVICE or RECOMMENDATIONS AND WARNINGS
OF THE MANUFACTURER.; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known or
readily foreseen at the time of purchase, handling, or use; (d) the BUYER/USER FULLY AGREES AND ASSUMES ALL SUCH
RISKS, AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES.
Upon purchase, the buyer agrees to hold DAVID R. BECK, KNIFESMITH, LLC not responsible, or liable for any personal injury,
economic loss, injury or damage to property, or for any accidental, or consequential damage resulting from the handling, use,
misuse, abuse, or neglect of our products.
All knives are shipped insured for the full purchase price, which covers loss or damage while in transit. Coverage ends upon delivery, at which time, the addressee is responsible for securing their shipment. David R. Beck Knifesmith LLC is not liable, nor responsible, for replacement, or reimbursement for items stolen after delivery.
Upon purchase, the buyer willfully agrees with, and states that, he/she has fully read, understands and accepts all provisions
included in this DISCLAIMER, LIMITATION of LIABILITY, and the RETURN POLICY and WARRANTY listed below as binding
TERMS AND CONDITIONS OF SALE.
SATISFACTION GUARANTY AND RETURN POLICY
FROM THE DATE OF DELIVERY, BUYERS HAVE A (5) DAY PERIOD TO EXAMINE THEIR PURCHASE. IF FOR ANY
REASON DURING THIS PERIOD, YOU ARE NOT FULLY SATISFIED WITH YOUR PURCHASE, DAVID R. BECK,
KNIFESMITH, LLC MUST BE CONTACTED AND BUYERS WILL HAVE THE OPTION TO RETURN THE MERCHANDISE
EITHER FOR EXCHANGE OR FULL REFUND. (*NOTE: DUE TO THE HIGH COST OF FOREIGN SHIPMENTS, NO SHIPPING
COSTS FROM FOREIGN PURCHASES ARE REFUNDABLE).
*EXCEPTION: Purchases from retail sellers must be returned to the place of purchase for refunds or exchanges and are subject to
that venders terms and conditions.
Returned merchandise must be in its original, new, and unused condition as delivered. DAVID R. BECK, KNIFESMITH, LLC
reserves the right to; (a) charge a reasonable fee for services required to repair, or restore for resale, any returned merchandise
showing wear or damage; (b) reject , and return to the customer "as is", and at the customer's expense, any returned merchandise
showing wear or damage from handling, use, misuse, abuse, or neglect, unless upon our inspection we determine the cause of
such to be the result of a defect.
Products fabricated per special request which include; (a) design modifications, including customized alterations and
ornamentation; (b) items crafted using services, materials and other additions not offered by our company as standard options
from our shop, or services rendered by others outside of our company at the request of the customer or; (c) designs duplicated
from customers drawings, are not returnable for exchange or refund. Merchandise produced from a customer's design, and made
to their specifications which are not liked, are considered to be a "designer's flaw" of its creator, and not a defect or flaw of the
manufacturer.
*Note: Although we take great care to produce the highest quality knives possible, buyers are aware and agree that any product
entirely manufactured by the human hand can vary slightly in dimension, feel, fit and appearance from one knife to the next.
LIMITED LIFETIME WARRANTY
All knives and cutting tools manufactured by DAVID R. BECK, KNIFESMITH, LLC come with a Limited Lifetime Warranty
against defects in both materials and craftsmanship for the life of the original owner. Unless otherwise stated in a products
description, sheaths and all other products manufactured by DAVID R. BECK, KNIFESMITH, LLC come with a (5) year Limited
Warranty against defects in materials and craftsmanship.
This Warranty does not cover; (a) NORMAL WEAR AND TEAR; (b) the stability of natural handle materials made from wood,
bone, horn, antler, ivory, or other materials similar in nature (as they are susceptilbe to adjusting to the environmental conditions
of their locality for which we have no control); (c) blade discoloration, finish wear, rust and corrosion; (d)DAMAGE CAUSED BY
ABUSE, MISUSE, NEGLECT, IMPROPER MAINTENANCE, OR FROM ANY MANNER OR USE FOR WHICH THE KNIFE OR
CUTTING TOOL IS NOT INTENDED, which includes but is not limited to, using as a hammer or screw driver, for digging,
prying, throwing, being struck upon, sharpening on a motor-driven grinder or sharpener, chopping or cutting bone, stone or
materials of similar, potentially damaging characteristics; (e) SECOND PARTY ALTERATIONS which includes any modification,
service, or repair performed by anyone other than DAVID R. BECK, KNIFESMITH, LLC; (f) OTHER: WEAR OR DAMAGE
RESULTING FROM FAILURE TO FOLLOW THE DIRECT ADVICE OR RECOMMENDATIONS OF THIS MANUFACTURER,
including what can be considered common sense as it applies to handling, use and maintenance.
*Note: The most common damage considered by our company as a sign of abuse or misuse are broken blades or tips, chipped
blade edges, and cracked handle grips.
* A defect, or damage as the result of a defect, can only be determined by careful examination by the manufacturer, and only
DAVID R. BECK, KNIFESMITH, LLC can make warranty determinations on its products. Should you believe a product you
purchased contains a defect, or was damaged due to one, for safety, and to avoid possible additional damage, or risk of injury,
discontinue use and contact us so a prompt evaluation can be performed and we can assist with a timely remedy. Defective
products are promptly repaired or replaced with a duplicate item (at our professional determination and discretion) at no charge.
Customer incurred shipping costs to return damaged merchandise for repair or replacement are not refundable.
Items returned for repair not covered by our warranty will be charged a reasonable fee only for services requested plus return
shipping costs. No repair is ever performed without customer consent. DAVID R. BECK, KNIFESMITH, LLC assumes no liability
for lost or damaged items returned uninsured. This warranty covers the original buyer only and is not transferrable.
EXCEPT AS STATED ABOVE, THE COMPANY MAKES NO EXPRESS OR IMPLIED WARRANTY REGARDING USE FOR A
PARTICULAR PURPOSE OR MERCHANTABILITY OF THIS PRODUCT.
